The purpose of these terms and conditions is to specify the terms of use and navigation within the eSanté Portal. They may be modified at any time by decision of Agence eSanté and any new version will come into force on the date of its publication.
These terms and conditions apply to all internet users accessing the eSanté Portal, and each internet user is deemed to have accepted these terms and conditions without reservation by continuing to use the Portal and is therefore bound to comply with them.
Purpose of the eSanté Portal
The purpose of the eSanté Portal is to present, through its various sections, Agence eSanté, its activities and news relating to the health and e-health sector in Luxembourg and Europe, in particular the actions and services implemented in this field for citizens and professionals active in the sector.
The eSanté Portal also allows :
- Users to search for healthcare professionals, hospitals and care facilities established in Luxembourg and obtain their contact details as registered with the Ministry of Health and Social Security;
- Access to a document database centralising all documents and presentations concerning the latest news on Agence eSanté, the eSanté Platform, the Luxembourg healthcare sector and the healthcare domain in general;
- The conduct of anonymous surveys on the eHealth sector;
- To contact Agence eSanté using the forms provided.
Agence eSanté makes every effort to publish and disseminate up-to-date and accurate information, and demands the same attention accurateness from its sources. However, despite this vigilance, some errors may be present. Internet users are invited to alert Agence eSanté of any such errors so that the necessary corrections can be made.
The eSanté Portal also allows users, after having logged in as a patient or healthcare professional, to access the various eSanté Services made available to users of the eSanté Platform in accordance with Articles 60ter and 60quater of the Social Security Code defining Agence eSanté’s missions.
It is specified in this regard that once logged into their private space, the internet user leaves the eSanté Portal for the eSanté Platform and is then subject to the general terms and conditions of use of the eSanté Platform and, where applicable, the Special Terms and Conditions of eSanté Services in place of those of the present legal notice.
Intellectual Property
All rights attached to any content published on this site are the property of Agence eSanté, unless otherwise stated that/where property of content is attributed to a third party who has authorised Agence eSanté to publish it. This includes, but is not limited to, any trademark, name, logo, image, photo, video, drawing, text, animation, feature, or graphic charter, whether or not they are protected by industrial property rights, copyright, or intellectual property rights.

Any representation, reproduction, adaptation or distribution, in whole or in part, of any element or content of this site on any medium and by any means whatsoever is prohibited without the prior authorisation of Agence eSanté. Any action or attempt at decompilation or intrusion by Internet users may also be prosecuted in accordance with the applicable legal provisions.
However, Agence eSanté tolerates the reuse of published information strictly for private and informational purposes, provided that the source is clearly mentioned and that a link to the eSanté Portal is provided.
In this context, Agence eSanté allows Internet users to share any information accessible on the eSanté Portal with their acquaintances via the email sending function. In this context, Internet users are prohibited from sending abusive emails to third parties that may infringe on the rights of others.

Agence eSanté cannot be held liable for any damage or effect that may result from incorrect or obsolete information published on the eSanté Portal.

Agence eSanté cannot be held liable in any way as a result.
Any hypertext link to this site may only be created with the authorisation of Agence eSanté, without prejudice to the provisions of the above article. Agence eSanté reserves the right to request the removal of any existing links that contravene this provision.
In general, the presence of a link on the eSanté Portal to an external site, or on an external site to the eSanté Portal, shall in no way imply that Agence eSanté endorses, supports, participates in or agrees with the content of the external site.
Internet users are invited to contact Agence eSanté to report any malfunctioning links.
Data protection
The purpose of this article, in accordance with the General Data Protection Regulation ((EU) 2016/679) in force on 25 May 2018, is to inform internet users of their rights and how data collected from them with their consent through the eSanté Portal's features may be used.
Agence eSanté does not collect any personal data without obtaining the prior consent of the internet user by any means.
In this context, Agence eSanté only requests personal data for the following purposes:
- Allow a user to subscribe to the newsletter by providing a valid email address;
- Contact Agence eSanté via the online contact form to ask a question or obtain information about Agence eSanté, its activities, its services or the healthcare system;
- Send a link to an article published on the eSanté Portal to a friend by email.
It should be noted that survey questionnaires are anonymous and therefore do not collect any data that could identify users. Only a cookie is used to identify responses to a survey in order to prevent multiple responses (see the following article on cookies).
Each form used to collect personal data clearly indicates the mandatory information to be provided by the internet user. This information is stored until the user unsubscribes from the newsletter, provides the required responses and details, or sends the email. The data will be hosted in Luxembourg.
Under no circumstances will the data collected be used for purposes other than those mentioned above, and it will not be transferred to other persons without the user's consent, with the exception of subcontractors acting on behalf of Agence eSanté exclusively within the framework of its instructions.
Agence eSanté undertakes to take all necessary measures to ensure the confidentiality and security of the data collected, and to prevent any disclosure or use that does not comply with these terms and conditions.
In accordance with the General Data Protection Regulation ((EU) 2016/679) in force on 25 May 2018, each internet user has the right to access, rectify and oppose the data collected. Internet users may exercise their rights by contacting Agence eSanté by post at the address mentioned in the preamble, or by email at "privacy@esante.lu".
Cookies
The eSanté Portal uses cookies to ensure its proper functioning, its availability in relation to traffic observed, and to optimise navigation for Internet users. Agence eSanté does not use any software or programmes that would allow it to track or spy on individuals, and in general no personal information is collected by these means.
