Call for referrals under the SONS scheme ‘Wave 2: assistance with compliance with digital transmission’ set up by Agence eSanté (AeS) as part of the digital obligation under the CNS-AMMD Agreement

Agence eSanté - Agence nationale des informations partagées dans le domaine de la santé G.I.E., hereinafter referred to as “AeS”, has been mandated by the Caisse nationale de santé, hereinafter referred to as ‘CNS’, and the Government of the Grand Duchy of Luxembourg to set up a scheme to assist compliance with the digitisation of the healthcare system in Luxembourg, known as the SONS scheme “Wave 2: assistance with compliance with digital transmission”. The aim of this scheme is to make a financial contribution to the costs incurred by publishers of business software for doctors and dentists, hereinafter referred to as ‘M/MD’, in order to install a version of their software incorporating an eConnector from the CNS, enabling standardised digital forms with an electronic signature to be sent.

Through the SONS ‘Vague 2: aide à la mise en conformité à la transmission numérique’ scheme, AeS is contributing a lump sum of €640 (inc. VAT) following any new installation of a referenced software solution incorporating a CNS eConnector, as specified in the referencing specifications file (DSR) for the SONS ‘Vague 2: aide à la mise en conformité à la transmission numérique’ scheme published on the website [1] of Agence eSanté.

The mechanism chosen is that of an open and non-selective system, hereinafter referred to as ‘SONS’, which does not grant any exclusivity to Industrialists, the latter having to comply with the conditions of the DSR of the SONS ‘Wave 2: aid for compliance with digital transmission’ scheme. All Manufacturers who meet the conditions defined by the SONS ‘Wave 2: support for compliance with digital transmission’ scheme may enter the scheme throughout its duration.

The SONS "Wave 2: aide à la mise en conformité à la transmission numérique" is not covered by Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement [2], Directive 2014/25/EU of the European Parliament and of the Council of 26 February 2014 on the procurement of entities operating in the water, energy, transport and postal services sectors [3], or Directive 2014/23/EU of the European Parliament and of the Council of 26 February 2014 on the award of concession contracts [4]. In addition, the SONS ‘Wave 2: support for compliance with digital transmission’ does not fall under the amended law of 8 April 2018 on public contracts [5], or the amended law of 3 July 2018 on the award of concession contracts [6], to which the Industrialist submitting a request for referencing does not intend to submit this call for referencing and subsequent acts.

Consequently, this call for referencing does not constitute a ‘contract notice’ or a ‘concession notice’.

Scope: This call for tenders is limited to M/MD software solutions in accordance with the definitions, criteria and requirements set out in the SONS ‘Wave 2: support for compliance with digital transmission’ referencing specifications document (DSR).

Access conditions: All manufacturers able to integrate the interoperability functions necessary for the proper operation of the eConnector CNS are concerned by the call for referencing.

Conditions for referencing: Agence eSanté will issue a listing to any manufacturer that markets software covering the functional scope of the DSR for the SONS ‘Wave 2: assistance with compliance with digital transmission’ system and meeting the criteria and requirements of the DSR.

Admission period: The opening date of the SONS ‘Wave 2: assistance with compliance with digital transmission’ is the date of publication of this call for referencing. The end date for the period for receiving applications for referencing is 1st July 2026. During this period, any Industrial Operator who fulfils the conditions laid down and who submits an application for listing in due form will be admitted to participate in the open, non-selective system.

Financial terms: A lump sum of €640 including VAT will be paid to the Industrial Operator for each installation of a version of its business software incorporating the CNS eConnector, with proof of use by an M/MD, at an M/MD, in accordance with the DSR, and invoiced in due form in accordance with the funding terms specified in the DSR.
